PULLOVA RIDESHARE TERMS & CONDITIONS
Company: Pullova Technologies Inc.
Service: Pullova Rideshare Platform
Effective Date: 26-05-01
These Terms govern access to and use of the Pullova Rideshare platform, including mobile applications, websites, and related transportation services. By accessing or using the platform, you agree to these Terms.
1. PLATFORM SERVICES
Pullova provides a technology platform connecting riders seeking transportation services with independent drivers who provide transportation services. Pullova does not provide transportation services and does not operate as a transportation carrier. Drivers are independent service providers.
2. ELIGIBILITY
Users must be at least 18 years of age, create an account with accurate information, and maintain valid payment credentials.
Drivers must maintain a valid driver’s license, vehicle registration, and required insurance coverage.
3. ACCOUNT REGISTRATION
To access services, users must create an account and provide accurate personal information. Users are responsible for safeguarding their login credentials. Pullova may suspend accounts if fraudulent activity is detected.
4. SMS & OTP COMMUNICATION CONSENT (TELNYX COMPLIANT)
Pullova uses SMS messaging, including One-Time Password (OTP) authentication, to support account security and service delivery.
4.1 Consent to Receive Messages (OPT-IN)
By providing your mobile phone number during registration, login, or account use, you expressly consent to receive transactional SMS messages from Pullova. These messages may include verification codes (OTP), ride confirmations, driver arrival notifications, account security alerts, and customer support communications. You acknowledge that consent is not a condition of purchase, message frequency varies depending on usage, and message and data rates may apply.
Example Disclosure
"By providing your phone number, you agree to receive account verification and service-related messages from Pullova. Message frequency varies. Message & data rates may apply. Reply STOP to opt out or HELP for assistance."
4.2 Opt-Out Instructions
Users may opt out of SMS communications at any time by replying STOP. After opting out, you will receive a confirmation message and will no longer receive SMS messages except where required for legal or security purposes. Opting out may limit your ability to log in securely, receive ride updates, and access certain platform features.
4.3 Help Instructions
For assistance, users may reply HELP or contact: support@pullova.com
4.4 Message Classification
Pullova sends transactional messages only, including authentication messages (OTP), ride-related notifications, and service updates. Pullova does not send marketing messages without separate explicit consent.
4.5 Third-Party Messaging Providers
SMS messages may be delivered via third-party providers including Telnyx, Twilio, and Bird. These providers act solely as message delivery processors.
4.6 Consent Recordkeeping
Pullova maintains records of user consent including phone number provided, timestamp of consent, IP address, and method of opt-in (app or website).
5. RIDE REQUESTS
When a rider requests transportation, the system matches the rider with an available driver, the rider receives ride details, and the driver completes the trip. Drivers may decline ride requests.
6. PRICING
Trip fares may include base fare, time and distance charges, surge pricing, and platform service fees. Prices are displayed before confirmation where possible.
7. USER CONDUCT
Users agree not to engage in illegal activities, damage vehicles, harass drivers or riders, or misuse the platform. Violations may result in suspension.
8. SAFETY POLICY
Pullova maintains a zero-tolerance policy regarding harassment, discrimination, violence, and unsafe conduct. Users may report safety concerns through the platform.
9. INSURANCE REQUIREMENTS
Drivers must maintain insurance coverage required by local law, including automobile liability insurance, rideshare insurance endorsement, and property damage coverage. Drivers are responsible for maintaining valid insurance.
10. LIMITATION OF LIABILITY
Pullova provides a technology platform only. To the maximum extent permitted by law, Pullova shall not be liable for acts or omissions of drivers or damages resulting from transportation services provided by independent drivers.
11. FORCE MAJEURE
Pullova shall not be liable for service interruptions caused by events beyond its control including natural disasters, telecommunications outages, government actions, and public health emergencies.
12. ARBITRATION AND DISPUTE RESOLUTION
Disputes may be resolved through binding arbitration where permitted by law. Users agree to resolve disputes individually and not through class actions.
13. GOVERNING LAW
These Terms shall be governed by the laws of the jurisdiction where Pullova operates the service.
